Western Upstate MLS Statement on NAR Delayed Marketing Exempt Listing (DMEL) Policy

After careful review, Western Upstate MLS will not be making any system changes to comply with NAR’s DMEL policy. We’ll continue using tools already available in our system that meet the same goals without creating extra confusion, while at the same time remaining compliant with the policy.

We want you to clearly understand why this decision was made and what it means for you and your clients.

Key Points

  • The WUMLS Board of Directors voted not to add a new listing status or restrict IDX/syndication because our current system already provides these options.
  • Our goal is to keep things simple, clear, and transparent for you and your clients.
  • Adding another status would only complicate the process and confuse both MLS members and consumers.

Why We Aren’t Making Changes

In short, the new policy doesn’t give sellers any real new choices or benefits. Instead, it would:

  • Create compliance confusion
  • Add overlapping statuses
  • Make it unclear to clients where their listings would actually show up

We do not believe this serves our members or their clients well.

What WUMLS Will Do Instead

WUMLS will continue using the current Active status, which already meets the intent of the NAR policy while providing clear and concise instructions for members when clients do not want their listings shared publicly.

Bottom line:

WUMLS believes that adding another status would only complicate things, while our current system already provides the transparency and flexibility sellers need.
