One of the duties stated in license law is that each BIC will assure that any associated licensee has a valid, active real estate license.  Since the renewal date of June 30 has passed, it is now IMPERATIVE that each BIC review the licensed status of all associates.

Follow this link to click on a list of licensees that you supervise.

Put in your company name to bring up a list of licensees that are associated with your company. Click on each one to see if the license is active.  Each license should have an “active through” date of 06/30/2019 or 06/30/2020.

If you find that one of your associates did not renew or does not have an active license, YOU MUST CORRECT THE SITUATION IMMEDIATELY.

An inactive licensee is not allowed to receive funds and cannot engage in the practice of real estate in any way.  This includes placing referrals. If you allow an unlicensed person to continue to practice under your supervision, both you and the inactive licensee can be reprimanded.

June 2018 Market Reports are Out

We are firmly within summer during an economically strong year in the U.S., thus real estate activity is busy. There are still generally more buyers than sellers in most price and housing style categories, so prices will continue to rise until that situation changes. For the 12-month period spanning July 2017 through June 2018, Pending Sales in the Western Upstate region were down 2.7 percent overall. The price range with the largest gain in sales was the $150,001 to $200,000 range, where they increased 8.3 percent.

SC Real Estate Commission Publishes Opinion on “Pay At Close”

The SC Real Estate Commission has addressed whether the practice of an associated licensee being paid directly at closing is allowed under the SC Real Estate Practice Act.

The Commission’s interpretation is that ”Pay at Close” violates the law and is not permissible.  The section of the law that is applicable is 40-57-135 (B) and reads: “ An  associated licensee may not receive compensation from an activity requiring a real estate license from an entity or person other than the one for which the license is issued”.  This ruling would apply, as well, to team leaders paying team members directly as opposed to the team member’s fees coming from the BIC.

Since the REC has published this ruling, it is mandatory that everyone is in the strictest compliance.
