We Cannot Do It…

Interpreting laws, rules, or specific contracts means giving legal advice.  The Association staff is prohibited from interpreting contracts or giving legal guidance to members or citizens.

If you need legal advice, please speak to your BIC or attorney.  The SCR Legal Hotline is also available to answer general questions through the two attorneys on SCR staff. They can be reached at (803) 772-5206.

If a consumer needs legal advice, particularly on the interpretation of a contract term, please refer them to an attorney to avoid engaging in the unauthorized practice of law.

The dictionary definition of “interpret” is stated as:  to explain or tell the meaning of, to present in understandable terms, or to conceive an answer in the light of individual belief, judgment, or circumstance.  This definition makes it clear that interpretation may involve subjectivity or opinion of the interpreter.  Attorneys can interpret, provide opinions and give advice.  WUAR staff cannot.

Anderson County Conservation Subdivision Information

Jeff Parkey, Planning Director of Anderson County, has asked that we share the following information with you.

“Conservation subdivisions” are a type of residential development in which some number of buildable lots are set aside as shared open space for the enjoyment of residents. These subdivisions still yield the same number of units as a conventional plan would, and with less infrastructure. The Anderson County Council is considering possibly making changes to our subdivision ordinance to allow for/encourage these types of developments. Council wants to make the development community aware of this concept, and also to get feedback on the idea. Click here to view a document provides more information.

Anderson County is in the process of organizing a larger meeting on this topic to be held in December, specifically for REALTORS, homebuilders, and developers in the area. We will keep you up to date as this event comes together.
If there are questions, please contact Jeff at 260-1075 or email him at

As we get more information we will share with you.

September 2019 Market Reports

As we move into the final months of 2019, buyers will find fewer homes coming on the market, but also less competition for those homes. The real estate market this fall is looking healthy. With a strong economy and great mortgage rates, there is a lot to remain optimistic about. For the 12-month period spanning October 2018 through September 2019, Pending Sales in the Western Upstate region were up 1.3 percent overall. The price range with the largest gain in sales was the $200,001 to $300,000 range, where they increased 9.8 percent.
